Information notice relating to the processing of personal data of laboratory patients

Inovie Africa undertakes to comply with European Regulation 2016/679 of 27/04/2016 relating to the protection of personal data and the Data Protection Act of 06/01/1978 as amended.

We therefore provide you with this information notice to inform you of the rights you have with regard to the management of personal data concerning you.

Therefore, we ask that you read the information detailed below and immediately notify our Personal Data Protection Officer (DPO) at the following address: contactdpo@inovie.fr, in case of refusal on your part for the processing of your personal data.

List of personal data collected by Inovie Africa

Inovie Africa only collects the personal data strictly necessary for the performance of medical biology procedures for its patients, the interpretation of the results of examinations carried out, the restitution of examination reports and the invoicing of said examinations.

Thus, Inovie Africa will be required to collect in particular:

  • your identity (user name, birth name, first name, biological sex, date of birth),
  • your social security number, your national health identifier (INS)
  • your address, your postal address, your telephone number, your mobile number, your e-mail address,
  • the contact details of your social security center and your mutual insurance company,
  • relevant clinical information (known illnesses, medical history, treatments, etc.),
  • the identity of the doctors you consult,
  • the results of the analyzes we carry out for you.

This data can be collected directly (when you go to the laboratory), but also through your home nurse, or your doctor in the event of hospitalization. In all cases, you have the right to access and rectify this personal data detailed below.

Lawfulness of processing – Refusal of processing

As part of your support by Inovie Africa for the termination of your medical examinations, the processing of your personal data is imposed by the technical tools put in place at the Inovie Africa laboratory and by the terms of the financial support of your care (teletransmission and delegation of payment). The legality of the processing carried out in this context by the laboratory for medical data is based on Articles 9.2.h and 9.3 of the GDPR. They do not require specific consent from you.

As part of the regulated retention period for your biological samples, Inovie Africa may be required to distribute said samples to its partners along with your pseudonymised and non-directly identifying personal data, and this, for the exclusive purpose of controlling medical devices. in vitro diagnostics and/or comparison of methods, unless you object at any time to the medical secretariat of your laboratory, in application of the provisions of article L 1211-2 of the Public Health Code.

Right of access and rectification

In addition to the previous paragraph, we inform you that, in accordance with the regulations in force relating to the protection of personal data, you have at any time a right of opposition, access, rectification, erasure, limitation and portability of personal data concerning you (within the limits of compliance with the legal obligations imposed on Labosud with regard to biological examinations and in particular the archiving of their results).

Data recipients and processors

Inovie Africa is the main user and data controller of your personal data.

However, it may happen that the examinations prescribed for you require the use of a second-line laboratory. In this case, we transmit your biological sample accompanied by all or part of the personal data concerning you. You will be informed, if necessary, by the secretary or the sampler in charge of your file of this transfer. We regularly check the skills of our subcontractors, including their methods of processing the personal data that we transmit to them.
Some of the personal data that we hold (identification, contact details, biology results) may also be transmitted to the professionals in your care pathway (hospitalization establishment, prescribing doctors, nurses) as part of the transmission of our medical reports. examinations, or to all professional partners of Inovie Africa as part of the management of your medical file (health data hosts, collection companies, companies of the same group, etc.).
Furthermore, in the context of the secondary use of your biological samples for the purposes of checking in vitro diagnostic medical devices and/or comparing methods, or for the purposes of statistical studies, your samples and your data Personal data may be transmitted to certain partners of Inovie Africa, anonymously or pseudonymized (indirectly identifying data).

The duration of the conversation

Your personal data will be kept in compliance with current regulations on the storage of medical biology samples, namely 10 years for the results of examinations and the elements related thereto.
